Rubbish Removal Belgravia Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Belgravia provides rubbish removal, waste collection and associated services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation that requests or receives the services.

Services means any rubbish removal, waste collection, clearance, loading, transportation, disposal, recycling or related services carried out by or on behalf of Rubbish Removal Belgravia.

Waste means any items, materials or substances requested to be removed or collected as part of the Services.

Contract means the agreement between Rubbish Removal Belgravia and the Customer incorporating these Terms and Conditions.

2. Scope of Services

Rubbish Removal Belgravia provides domestic and commercial rubbish removal and waste collection services. This may include the loading of items from premises, gardens, offices, building sites and other locations, transport of waste, and delivery of that waste to licensed disposal or recycling facilities, in line with applicable waste management regulations.

The precise scope of the Services for each booking will be as described in the quotation or confirmation provided to the Customer. The Services do not include cleaning, repair work, electrical, plumbing or other specialist services, unless expressly agreed in writing.

We reserve the right to refuse to remove certain items, including but not limited to hazardous, toxic, medical, chemical, explosive or other restricted materials, where removal or transport would breach law, guidance or safety standards.

3. Booking Process

Customers can request a booking for rubbish removal or waste collection by telephone, email or other communication channels offered by Rubbish Removal Belgravia from time to time. When making an enquiry, you will be asked to provide information about the type, approximate volume and location of the waste to be collected, access arrangements and any special conditions.

Based on the information provided, we may give an estimated price or arrange a visit to assess the waste and confirm the quotation. Any quotation is issued on the basis that the information provided by the Customer is accurate and complete. If, upon arrival, the nature or volume of waste differs significantly from that described, we may adjust the price or decline to carry out all or part of the Services.

A booking is only confirmed when we send a confirmation message stating the agreed date, time window, and any applicable charges, and you accept that confirmation. By confirming the booking, the Customer enters into a Contract with Rubbish Removal Belgravia on these Terms and Conditions.

4. Access and Customer Responsibilities

The Customer must ensure that we have safe and reasonable access to the premises and any waste to be collected at the agreed time. This includes making sure that any necessary permissions, parking arrangements, gate codes, or entry instructions are provided in advance.

The Customer is responsible for ensuring that waste items to be removed are clearly identified and separated where requested, and that no prohibited materials are included. If any items are not to be removed, the Customer must clearly inform our team before loading begins.

The Customer warrants that they are entitled to request removal of the Waste and that the Waste is not stolen, unlawfully obtained or subject to third-party ownership rights. The Customer will indemnify Rubbish Removal Belgravia against any losses, claims or costs arising from a breach of this warranty.

5. Pricing and Quotations

Prices for rubbish removal and waste collection are usually based on one or more of the following: volume of waste, type of waste, weight, labour required, access conditions and disposal costs. Any quotation given before attendance is an estimate only, unless expressly described as a fixed-price quotation.

Where the volume or nature of waste differs from that initially described, we may adjust the price to reflect the actual load size, time on site, or additional disposal fees. We will inform the Customer of any price change before proceeding where practical. If the Customer does not accept the revised price, we may cancel the booking or limit the Services to the value originally agreed.

All prices are quoted exclusive of any applicable taxes unless stated otherwise. We reserve the right to change our general price lists and rates at any time. Such changes will not affect confirmed bookings already accepted by both parties.

6. Payments and Invoicing

Payment for the Services is due on completion of the rubbish removal, unless otherwise agreed in writing. We may accept payment by cash, card or bank transfer, depending on the agreed method at the time of booking or service delivery.

For business Customers or account holders, we may issue an invoice payable within a specified period. If an invoice is not settled by the due date, we reserve the right to charge interest on the overdue amount and to recover all reasonable costs incurred in pursuing payment.

Ownership of any Waste passes to Rubbish Removal Belgravia only when full payment for the relevant Services has been received, unless agreed otherwise in writing. Until such payment, we retain the right to reclaim costs arising from any non-payment, including by lawful means.

7. Cancellations and Rescheduling

The Customer may cancel or reschedule a booking by giving reasonable prior notice. We request at least 24 hours notice before the agreed arrival window. Where less than 24 hours notice is given, we reserve the right to charge a cancellation fee to cover our costs, including staff time and allocated vehicle resources.

If our team attends the premises at the scheduled time and is unable to gain access, or if the Customer is not present where presence is required, we may treat this as a late cancellation and may charge a wasted journey fee or a proportion of the agreed price.

Rubbish Removal Belgravia may cancel or reschedule a booking due to circumstances beyond our control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents, or legal restrictions. In such cases, we will notify the Customer as soon as reasonably possible and offer an alternative appointment. We will not be liable for any indirect or consequential losses arising from such cancellation or delay.

8. Service Delivery and Performance

We aim to arrive within the agreed time window; however, due to traffic, access issues and other operational factors, arrival times are estimates and not guaranteed. We will make reasonable efforts to inform the Customer of any significant delay.

Our staff will carry out rubbish removal and waste collection with reasonable care and skill. The Customer should inspect the area after completion of the Services and raise any concerns immediately with our team, or within a reasonable period after the visit. Any complaints will be handled in line with our complaints procedure, which can be requested from us.

Where partial completion occurs due to access restrictions, time limitations or changes requested by the Customer on site, the Customer may still be charged for the work already carried out and the volume of waste removed.

9. Waste Regulations and Prohibited Materials

Rubbish Removal Belgravia operates in accordance with applicable UK waste management regulations and aims to dispose of or recycle waste in a responsible and lawful manner. We will only use licensed facilities and will take reasonable steps to ensure that waste is handled in compliance with environmental and duty of care obligations.

The Customer agrees not to present any hazardous or prohibited waste for collection, including but not limited to asbestos, chemicals, solvents, oils, fuel, gas cylinders, clinical or medical waste, radioactive materials, and any other waste classified as hazardous under relevant legislation, unless expressly agreed in advance and where we are legally authorised to handle such material.

If prohibited or hazardous waste is discovered among the load without prior agreement, we may refuse to remove it, ask the Customer to segregate it, or apply additional charges for specialist handling and disposal where lawful and feasible. We may also suspend or terminate the Services if the presence of such materials poses a risk to health, safety or the environment.

10. Liability and Limitations

Rubbish Removal Belgravia will exercise reasonable care in performing the Services, including when removing items from inside or around premises. The Customer should move or protect any fragile items, valuables, or items of sentimental value that are not intended for removal. We will not be liable for damage to such items where they have not been properly separated or safeguarded by the Customer.

Our liability for loss or damage to property caused by our negligence will be limited to the reasonable cost of repair or replacement, taking into account fair wear and tear and the age and condition of the item. We do not accept liability for pre-existing damage, inherent defects or issues arising from normal handling of items in poor condition.

To the fullest extent permitted by law, we shall not be liable for any loss of profits, loss of business, loss of opportunity or any indirect or consequential loss or damage arising out of or in connection with the Services or these Terms and Conditions.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

11. Insurance

Rubbish Removal Belgravia maintains appropriate insurance cover for its activities, including public liability insurance at a level considered suitable for the nature of our rubbish removal and waste collection operations. Details of insurance can be made available upon reasonable request.

The existence of insurance does not extend or increase our contractual liability to the Customer beyond that set out in these Terms and Conditions. The Customer is responsible for arranging their own insurance cover for any specific risks or high-value items not expressly accepted by us.

12. Customer Data and Privacy

In order to provide the Services, we may collect and process personal data such as names, contact details, addresses, and payment information. We will use this data only as necessary to manage bookings, deliver the Services, take payment, and handle enquiries or complaints.

We take reasonable steps to safeguard personal data and to comply with applicable data protection requirements. By using our Services, the Customer consents to the collection and use of their information in accordance with our privacy practices, which are available on request.

13. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the rubbish removal or waste collection service, they should contact us as soon as possible, providing full details of the issue. We will investigate and respond within a reasonable time, seeking to resolve the matter fairly and efficiently.

Where a dispute cannot be resolved directly, both parties agree to consider alternative dispute resolution options before commencing court proceedings, where appropriate. This does not affect either party's right to bring a claim in the courts of the relevant jurisdiction.

14. Amendments to These Terms

Rubbish Removal Belgravia may from time to time update or amend these Terms and Conditions. Any changes will take effect when published or otherwise communicated to Customers. The Terms and Conditions applicable to a particular booking will be those in force at the time the booking is confirmed.

Continued use of our Services after changes have been notified will be deemed acceptance of the revised Terms and Conditions.

15. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, where this is not possible, it shall be severed from the remaining provisions, which shall continue in full force and effect.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Removal Belgravia.

By booking or using rubbish removal and waste collection services from Rubbish Removal Belgravia, the Customer confirms that they have read, understood and agree to these Terms and Conditions.
